EEOC) Charge Filing Statistics for the 2009 Fiscal Year

On January 6, 2010, the US Equal Employment Opportunity Commission (EEOC) released its charge filing statistics for the 2009 Fiscal
Year. I’ve included a link to the report here: www.eeoc.gov/eeoc/newsroom/release/1-6-10.cfm.
A total of 93,277 charges were filed with the EEOC in 2009, just slightly less than 2008’s record number of 95,402. From the report we
can see that the EEOC received 11,134 charges of national origin discrimination, 3,386 charges of religious discrimination, and 33,613
charges of retaliation. This latter category is now the most frequently cited allegations to be found in these filings, outpacing race
discrimination (33,579).
As I’m sure you have also experienced in your practices, these are among the most fractious – and expensive, from a damages
perspective – cases. Juries may relate to instances of discrimination based upon their particular experiences as protected class
members, but almost all of us can relate to the sense that a retaliatory or punitive action was taken after we pointed something out
that caused discomfort.
Perhaps the most impactful statistic to be reported by the agency is its recovery of damages: in 2009, the EEOC recovered $294
Million, a record. 281 lawsuits were filed by its Enforcement Division. Federal action has, and will continue to, swell the EEOC”s
resources upon which its efforts to reduce backlog and explore new avenues of action and recovery are based.
While agency conciliation/mediation processes can be hit and miss, private mediation is a successful alternative to litigation, and can
